Re:     Immigration Resources and Guidance

Our first duty when caring for patients is to ensure their safety and health above all other interests.

All clinicians as well as anyone who is authorized to document in a patient health record have responsibility under federal and state laws to protect patient confidentiality. When documenting in a patient’s health records, the MNA recommends that you only include those patient demographic data which are immediately relevant to presentation and care described in your note and please note that you are not required to reference a patient’s immigration status. 

If law enforcement personnel, including those from Immigration and Customs Enforcement (ICE) or the Department of Homeland Security (DHS), ask for a patient or patient information (or ask for an employee or employee information) the MNA recommends that you do not provide any information, but you should contact your supervisor immediately.

Your supervisor should be able to review any ICE/DHS request, warrant, or court order signed by a judge, by the employer’s legal counsel before any act is taken pursuant to the request, warrant, or court order signed by a judge.
